Regulation 2019/1020 on market surveillance identifies the following Directives and Regulations in Annex I. Products within this list require technical information to be held by an importer, fulfilment centre or Authorised Representative to be able to continue to supply the product or good into the EU from July 16th 2021. The Directive and Regulation list is below, with Authorised Representative duties identified.

The manufacturer always remains responsible for the safety and compliance of the machinery or products supplied.

Please note the Machinery Directive 2006/42/EC is being replaced by Machinery Regulation EU 2023/1230 on 20th January 2027.

This will require new assessments, specifically relating to Cyber Security and will require new Declarations as the text is changing.

Economic operators

The Machinery Regulation requires an economic operator to be established in the EU. Non-EU manufacturers are unlikely to appoint an importer or distributor to act as an economic operator because of the need to share sensitive technical information. The only practical option, therefore, is to appoint an authorised representative.

How to Comply

We suggest that competent people are used for this type of assessment. The majority of 'Machinery' consultants and organisations are not especially versed in Cyber Security.
